Absolutely not ! :) Without that, the following bug might show :
When running with a panel on top of the screen such as gnome panel or kde panel,
the user might move a window in a way that the title bar goes under the top
panel (panels are on a layer above other windows)
If this is done, the user cannot access the title bar of the window anymore
(because it's located under the panel) and thus cannot move the window. Yes, I
know, the user can still use alt+click to move the window, but this might not be
natural to most of the users.
Therefore, by preventing windows to be move above the upper margin, the user
cannot hide the title bar of windows under the top panel.
FYI, metacity has exactly the same behaviour...
